I represent companies facing disputes before any judicial authority (civil, commercial, French or European), arbitration authority (ad hoc or institutional) or alternative dispute resolution.

My preferred legal field     is litigation relating to the enforcement and annulment of arbitration awards, as well as cross-border disputes, including issues relating to jurisdictional disputes, contracts, unfair competition, product liability, as well as intellectual property (trademarks, designs, counterfeiting).

Arbitration

As a lawyer, I intervene in institutional and ad hoc arbitration, both international and domestic. My practice has led me to handle arbitration proceedings before the ICC (International Chamber of Commerce) and the CAIP (International Arbitration Chamber of Paris), in a range of fields spanning over construction, domestic and international trade of commodities, or commercial agency contracts.

As an arbitrator, I am regularly appointed as sole arbitrator, co-arbitrator or president of an arbitral tribunal in ad hoc or institutional proceedings. I have drafted arbitral awards in French, Italian and English languages, in matters covering notably commercial agency, commercial relations, construction and licensing.

Since the beginning of my professional career, I have developed, pursued and focused my activity on the search for the most efficient and straightforward outcome in resolving commercial disputes.

Once a dispute arises, my goal is to work closely with you to identify the most appropriate solution to achieve your desired outcome.

Trained in mediation, arbitration and litigation, I value exploring with my clients the various opportunities available to achieve the best result. Based on a thorough critical analysis of the case law and relevant legislations adjusted to your specific case, I am able to discuss and suggest the most appropriate solution for the case examined, be it negotiated, mediated or ruled upon by arbitrators or courts.

As both claimant’s and defendant's counsel, I act before French courts, commercial and civil, in simple and complex, national and cross-border disputes:

  • ordinary, such as the Commercial Court or the Court of First Instance

  • or special, such as the recognition, enforcement court before the Court of Appeal.

I often intervene in appeal and/or annulment proceedings of national or international arbitration awards before the Paris International Commercial Chamber of the Court of Appeal (ICCP-CA).

Admitted to the Paris Bar, I represent companies before all French courts anywhere in France and before the Court of Cassation, with the support of colleagues qualified before the relevant jurisdiction.

I pursue recognition and enforcement of the award or decision obtained, until the procedural result is obtained. Experienced in exequatur and enforcement procedures, I will conclude the case only once the desired outcome has been achieved or any penalties have been reduced to an acceptable level.

 

 

Commercial Law - Distribution

My methodology entails an examination of contract development through the lens of case law and pertinent legislation. I then proceed to address specific contract-related issues that may arise in practice, charting a legal course through them.

My work focuses on all kinds of litigation in the field of:

  • Contracts for the International Sale of Goods,

  • Contract law: pre-contractual statements, vitiating factors and unfair conduct, breach of contract, ending contracts, and remedies and restitution, terms and conditions, Limiting or extending liability, Assignment of obligations and novation …

  • Commercial agency: contract, legal relations between principal and agent as well as the relations between agent and third party, sub-agency and termination of agency.

  • Distribution law: disputes with suppliers, distributors, service providers, customers, sellers, buyers, subcontractors or with your distributors, commercial agents or brokers, dealers, franchising, etc.,

  • Industrial property, unfair competition, economic parasitism and restrictive practices of competition,

  • Liability for defective products and/or other hidden defects,

  • Insolvency proceedings: recovery of debts.

Prior to any proceedings, I intervene either in negotiations, expert opinions or before national courts or specialised arbitration institutions, up to and including the recognition and enforcement of decisions and awards where necessary.

 

 

European, French and Italian Law

Whether the issue at hand is a national or cross-border one, I will apply national law through the prism of EU law. This enables me to intervene before the Court of Justice of the European Union (CJEU).

My dual training and practice in France and Italy further allows me to work with all cultures whose source is based on civil law.

With the expertise to navigate the nuances of civil law-based cultures, I am confident in addressing these matters:  

  • Sources and coordination of EU regulations and/or directives, depending on the subject matter (intellectual property, commercial agency, defective products, hidden defects, enforcement of judgments, etc.).

  • The jurisdiction (Regulation (EU) No 1215/2012 (Brussels I bis), the 2005 Hague Convention, Regulation (EU) 2019/1111 (Brussels II ter), Regulation (EC) No 4/2009)

  • The applicable law (Regulation (EC) No 593/2008 (Rome I), Regulation (EC) No 864/2007 (Rome II).

  • The effectiveness of foreign judgments (Regulation (EU) No 1215/2012) (Brussels I bis), the 2005 Hague Convention, the 2019 Hague Convention, Regulation (EU) 2019/1111 (Brussels II ter), Regulation (EC) No 4/2009.

  • European proceedings to facilitate the circulation of enforceable titles: in particular, the European order for payment procedure and the European account preservation order. Cooperation between authorities of different States on service and evidence.

  • Contractual and/or non-contractual liability as distinct from liability for breach of obligations (sales contracts, preliminary contracts, confidentiality agreements, service contracts, conformity guarantees, etc.).

 

 

Private International Law and conflict law

My university education took place largely in France, alongside a year in Italy (La Cattolica University in Milan) and at the Hague Academy of Private International Law.

As a lawyer and arbitrator, I deal with the rules of private international law on behalf of a diverse range of companies from across the globe, on projects spanning the globe.

As a member of the Board of the Editions A. Pedone publishing house, my interest in international law definitely stems from my family origins. However, I have refined my expertise during my studies and in my current practice in a transalpine and international environment.

I deal on a daily basis with matters requiring the tools of private international law for foreign clients operating in France or for French clients operating abroad.

Matters involving:

  • the jurisdiction (depending on the contract/service or place of performance, jurisdiction clause, arbitration clause, etc.),

  • the applicable law (French law, Italian law, foreign law, mandatory provisions, international law of French conception, European law),

  • professional or commercial practices and international trade in goods and services,

  • Issues on contracts for the international sale of goods.

  • Intellectual property,

  • Transport.

 

 

Commercial Mediation

I am trained and certified in commercial mediations techniques (Chambre de Médiation et d'Arbitrage de Paris (2012) and Mediation School of the Paris Bar Association (2013), Milan Arbitration Chamber mediation training curriculum (2013). I undertook those programs in order to perfect this specific aspect of mediation, which requires a different approach to problem-solving.

Mediation is founded on perceiving the other party's perspective to facilitate effective negotiations and identify optimal solutions. As such, I deemed it crucial to undergo training in two countries and two languages, while simultaneously integrating an Anglo-Saxon perspective.

The conclusion of these extensive training sessions, which exceeded 300 hours in total, was the confirmation of my ability to represent a case effectively and to seek the best solution for my client, which will be in their best interests and will be achieved through a constructive and effective alternative solution.

As a lawyer, I am able to assist you in exploring the full scope of mediation and its underlying rationale. Together, we will identify your BATNA (Best Alternative to a Negotiated Agreement) and ensure that you maintain full control of the process, regaining your position as the primary decision-maker in the relationship with the other party, who may be a former partner.

 

 

Intellectual Property Law

Member of the APRAM (Association des Praticiens du Droit des Marques et des Modèles - French Association of Trademark and Design Law Practitioners) since 2010. Over the course of my tenure, I have developed a comprehensive expertise in the field of Intellectual Property and in particular:

  • Trademarks

  • Copyright

  • Industrial Designs

  • Trade secret.

I assist companies and individuals in protecting their Intellectual Property rights in cases of infringement, unfair competition and counterfeit. 

I represent clients before administrative and jurisdictional authorities in France and the European Union, in particular:

  • INPI (Institut national de la Propriété Intellectuelle - French National Intellectual Property Institute)

  • EUIPO (European Union Intellectual Property Office) and WIPO (World Intellectual Property Organisation)

  • French courts and institutional or ad hoc arbitration tribunals.

 In addition, I carry out various Intellectual Property advisory activities, such as:

  • Priority searches and feasibility studies,

  • Negotiations for the acquisition of rights and/or licenses for use,

  • Coexistence Agreements,

  • Administrative opposition proceedings and nullity and cancellation actions,

  • Court proceedings (interlocutory and substantive) for the protection of Intellectual Property rights and Unfair Competition,
